# Regulatory Daily Summary: What Happened on November 7, 2026

**FDA expands Rybrevant Faspro to previously treated head and neck cancer**

CMS finalized Medicare negotiation rules for new drug formulations, while biotech groups sued to block a separate pricing pilot.

## Today in brief

The FDA granted accelerated approval to Johnson & Johnson’s Rybrevant Faspro for some adults with recurrent or metastatic head and neck cancer after chemotherapy and immunotherapy. [1] [2] [3] CMS finalized rules that could bring some reformulated drugs into Medicare’s negotiated prices earlier. Biotech trade groups also sued to stop a separate Medicare pricing pilot. [4] [5]

## Rybrevant Faspro wins accelerated approval in head and neck cancer

The FDA approved Rybrevant Faspro for adults whose recurrent or metastatic head and neck squamous cell cancer worsened during or after platinum chemotherapy and treatment with a PD-(L)1 inhibitor. [1] [2] [3] The label excludes HPV-associated oropharyngeal cancer, and this is the drug’s first approved use outside lung cancer. [2] [3]

The decision relied on the single-arm OrigAMI-4 study, in which 42% of 102 patients responded and 15% had complete responses. [2] [3] Among responders, 56% had a response lasting more than six months. [2] [3]

Serious adverse reactions occurred in 39% of patients. Fatal adverse reactions occurred in 6%, including sudden death in 2%. [2] [3] The accelerated approval uses response rate and response duration as surrogate measures. Continued approval may depend on confirmation of clinical benefit in the Phase 3 OrigAMI-5 trial. [2] [3]

## CMS codifies negotiation rules for reformulated medicines

CMS finalized rules for Medicare drug-price negotiation, including how it will handle some fixed-combination formulations that change a drug’s administration route. [4] If the same application holder adds an ingredient that enables a different route, CMS will group qualifying versions for drug selection and negotiation. [4]

CMS gave the example of a negotiated price for a selected biologic also applying to its hyaluronidase formulation from 2029, rather than potentially waiting until 2039. [4] CMS said the policy is intended to prevent manufacturers from shifting patients to a new version to avoid the maximum fair price. [4]

The rule applies to drug selection and negotiation in 2027 for prices effective in 2029. The current guidance-based approach continues through 2028. [4] CMS also set a temporary price floor for qualifying small biotech drugs in 2029 and 2030, at 66% of the drug’s inflation-adjusted 2021 average non-federal manufacturer price. [4]

Commenters argued that subcutaneous reformulations require distinct clinical, manufacturing, pharmacokinetic, and regulatory work, with particular effects for smaller biotech and delivery-technology companies. [4] CMS described the policy as narrow and said it would monitor implementation and consider adjustments as it gains experience. [4]

## The day in numbers

- **42%**: Share of patients who responded in the 102-person OrigAMI-4 cohort supporting Rybrevant Faspro’s accelerated approval. [2] [3]
- **66%**: Temporary minimum price level for qualifying small biotech drugs in Medicare negotiations for 2029 and 2030, measured against an inflation-adjusted 2021 benchmark. [4]
