The settlement resolves six disputes involving patent, trade-secret and antitrust claims.1 Liquidia agreed not to challenge a court ruling that found it infringed two claims in a United Therapeutics patent.1

Liquidia will pay United Therapeutics $175 million by October 30, with possible extensions, followed by two payments of $72.7 million in 2027.1 It will also pay $60.3 million to parties with interests in a treprostinil-injection antitrust case and end its promotional arrangement for that product.1

Yutrepia can remain on the market for PAH, and Liquidia can develop it for uses other than PH-ILD, including Raynaud’s phenomenon associated with systemic sclerosis.1 Liquidia can also continue developing L606 for PH-ILD and PAH with Pharmosa Biopharm.1

Liquidia reported unaudited third-quarter Yutrepia sales of $222.7 million, up 31% from the second quarter.1 Executives said PAH accounted for 60% of sales, with the share trending toward 70%.1 Liquidia expects Yutrepia to exceed $1 billion in annual sales by 2028.1 United Therapeutics said it offered a settlement that would have kept Yutrepia available to PH-ILD patients, but Liquidia declined.1
